1. Definitions

1.1."Applicable Law" means all laws, rules, regulations and binding orders in force in India, including the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Food Safety and Standards Act, 2006 and the Central Goods and Services Tax Act, 2017.

1.2."Services" means the catering discovery, menu customisation, event booking, order tracking, payment and review services made available through the Platform.

1.3."Vendor" or "Caterer" means a food service provider, catering partner or kitchen that fulfils an Order placed through the Platform, whether operated by Book Your Menu or by an independent partner onboarded to the Platform. Where Book Your Menu fulfils an Order itself, "Vendor" means Book Your Menu acting in that capacity.

1.4."Package" or "Menu" means a defined set of food items, pricing and guest-count structure (for example, per-plate pricing and Veg/Non-Veg guest splits) listed on the Platform.

1.5."Order" or "Booking" means a confirmed request for catering services, including the selected Package, customisations, Add-ons, event details and agreed price.

1.6."Add-ons" means supplementary items or services offered with a Package (for example, tables, chairs, water bottles, serving staff, cutlery or dining kits), priced per unit, per person or as a flat fee, as displayed at checkout.

1.7."Event Date" means the date and time of service stated in your Order.

1.8."Advance" means the part-payment, if offered at checkout, that confirms an Order before the balance is paid.

1.9."Content" means all text, images, menu data, prices, ratings, reviews and other material on the Platform.

1.10."Account" means your registered profile, created by verifying your mobile number with a one-time password (OTP) or any other method the Platform supports.

2. Eligibility & Acceptance

2.1.You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872 to create an Account or place an Order.

2.2.If you use the Platform on behalf of an organisation (for example, to book a corporate event), you confirm that you are authorised to bind that organisation to these Terms, and "you" includes that organisation.

2.3.These Terms form a legally binding agreement between you and Book Your Menu. Continuing to use the Platform after an update to these Terms takes effect means you accept the updated Terms (see Section 19).

3. Account Registration & Security

3.1.Registration. Creating an Account requires a valid Indian mobile number verified by OTP. You may be asked for further details (name, date of birth, email, gender, address, profile photo) to complete your profile.

3.2.Accurate information. You agree to give accurate, current and complete information and to keep it updated. We are not responsible for any loss caused by inaccurate or outdated information you provide.

3.3.Keeping your Account safe. You are responsible for keeping your OTPs and device secure and for all activity under your Account. Never share an OTP with anyone. Book Your Menu staff will never ask for it. Tell us immediately at support@bookyourmenu.com if you suspect unauthorised use.

3.4.One Account per person. Each Account belongs to one individual or, for business bookings, one authorised representative. We may suspend duplicate, fake or fraudulent Accounts.

3.5.Closing your Account. You can ask us to delete your Account at any time through the app or at support@bookyourmenu.com. Some records (for example, completed order and tax records) will be kept as long as the law requires, as explained in our Privacy Policy.

4. Our Services

4.1.Through the Platform you can:

  • Browse food Packages by event type, meal type, catering style and venue type;
  • Customise Packages by adding, removing or replacing items within permitted categories;
  • Choose Add-ons such as furniture, utilities, cutlery and staffing;
  • Book an Event Date, time, guest count and service venue;
  • Pay in full or, where offered, pay an Advance and the balance later;
  • Track your Order through stages such as Order Placed, Booking Confirmed, Preparing Food, Out for Delivery and Event Completed;
  • Rate and review completed Orders and individual dishes; and
  • Manage saved addresses, past Orders and your profile.

4.2.Book Your Menu may act as the caterer for some Orders and, for others, as a marketplace that connects you with independent Vendors. Section 13 explains what that means for you.

4.3.We may add, change or withdraw features of the Platform at any time. Such changes will not reduce what you are entitled to under an Order that is already confirmed and paid for.

5. Booking & Order Confirmation

5.1.Choosing a menu. You select a Package based on event type, meal type, guest count, dietary preference (Veg/Non-Veg) and catering style (for example, Catering, Meal Box, Big Box or BBQ & Grill).

5.2.Customisation. You may customise a Package within the rules and prices shown at the time. Customisation charges are itemised separately from the base Package price at checkout and in your Order details.

5.3.Add-ons. Add-ons are priced by their pricing type (per person, per unit or flat) and may have minimum quantities, which are shown before you add them.

5.4.When your Order is confirmed. Placing an Order is an offer to buy the selected Package, customisations and Add-ons at the displayed price. A contract is formed only when (a) your payment (in full, or the required Advance) is successfully received, and (b) we send you an Order confirmation with an Order Number.

5.5.Check your details. Before you pay, please check the Event Date, time, guest count, venue address, contact person and special instructions. Changes after confirmation depend on Vendor availability and may cost extra.

5.6.Order status. We make reasonable efforts to keep Order status accurate, but some updates depend on the Vendor and may not appear in real time.

5.7.Our right to decline. We may decline or cancel an Order if the venue, date or guest count is outside our serviceable area or capacity, if we reasonably suspect fraud, if the price shown was a clear error, or if no Vendor can fulfil it. If we do, we will tell you promptly and refund 100% of the amount you paid to your original payment method.

6. Prices, Taxes & Payment

6.1.Prices. All prices are in Indian Rupees (₹). Package prices are quoted per plate or guest and multiplied by the confirmed guest count, plus customisation and Add-on charges. The total payable, including all taxes and charges, is shown before you pay. We do not add hidden charges.

6.2.Taxes and invoices. Goods and Services Tax (GST) and any other statutory levies are shown in your order and payment summary. A tax invoice is issued for every paid Order.

6.3.Payment methods. Payments are processed by our payment partner (currently Razorpay). Your payment is also subject to that partner's terms. We do not store your full card, UPI or bank details.

6.4.Advance and balance. Where offered at checkout, you may pay (a) the full Order value when booking, or (b) an Advance (up to 30% of the Order value) with the balance due by the date shown at checkout. If the balance is not paid by that date, we may treat the Order as cancelled by you, and the Cancellation & Refund Policy will apply.

6.5.Failed payments. If a payment fails or cannot be verified, the Order is not confirmed. You can retry from the Orders section ("Pay Now"). If money is debited for a failed payment, it is usually reversed automatically by your bank or our payment partner; if not, contact us and we will help.

6.6.Price changes and errors. Prices may change at any time, but a change will not affect an Order already confirmed. If a price was clearly wrong because of a technical or typographical error, we may cancel the Order and give you a full refund, or offer it to you at the correct price.

6.7.Offers and coupons. Promotions, coupons and referral rewards have their own conditions, have no cash value unless stated, and may be changed or withdrawn. Changes will not affect Orders already confirmed with a valid code.

6.8.Chargebacks. If you raise a chargeback for an Order that was delivered as agreed, we may share Order evidence with your bank and suspend your Account while the dispute is resolved.

7. Cancellation, Rescheduling & Refunds

7.1.Cancellations, rescheduling and refunds are governed by our Cancellation & Refund Policy, which forms part of these Terms. If that policy conflicts with this Section, the policy prevails for those matters.

7.2.If we cancel, for any reason other than your breach of these Terms, you will receive a full refund of the amount paid.

7.3.If you cancel or reschedule, any charges depend on how close to the Event Date you do so, because food, staff and materials are arranged in advance. The applicable charges are set out in the Cancellation & Refund Policy and shown in the app before you confirm.

7.4.Refund timelines. Approved refunds are sent to your original payment method. They normally reach your account within 5–7 working days after we process them, depending on your bank or payment provider.

7.5.No-show or no access. If the Vendor arrives at the agreed venue and time but cannot serve because the venue is closed, inaccessible or unsafe, or no one is available to receive the service, the Order may be treated as fulfilled and refunds may be limited under the Cancellation & Refund Policy.

8. Delivery, Setup & Event Day

8.1.Venue access and permissions. You are responsible for giving the Vendor reasonable access to the venue at the agreed time (including parking, loading and setup space) and for obtaining any permissions the venue or local authorities require for your event.

8.2.Timings. Delivery and setup times are estimates. Delays caused by traffic, weather, venue restrictions or other events outside our or the Vendor's reasonable control are not, by themselves, a breach of these Terms. We will try to tell you about significant delays.

8.3.Guest count changes. Changes to the guest count after confirmation depend on Vendor capacity. An increase may require extra payment. A reduction close to the Event Date may not reduce the price, because food is prepared for the confirmed count.

8.4.Add-ons. Furniture, utility and staffing Add-ons are provided subject to availability. If one becomes unavailable, we or the Vendor will offer a reasonable substitute or refund that Add-on.

8.5.Rented items. Furniture, equipment and serving items provided as Add-ons remain the Vendor's property. You are responsible for loss or damage to them during your event beyond normal wear and tear, and we may charge the reasonable cost of repair or replacement.

8.6.After handover. Food is prepared to be eaten fresh. Once food is handed over or served, we are not responsible for food that is consumed after the service window advised by the Vendor, or that is stored, reheated or handled improperly. We advise against packing leftovers for later use.

9. Food, Allergens & Dietary Needs

9.1.Allergens. Our kitchens and Vendors may handle common allergens, including nuts, dairy, gluten, soy, eggs, sesame and shellfish. Ingredient and allergen information is provided in good faith, but cross-contact cannot be completely ruled out.

9.2.Tell us in advance. You must tell us about any allergy, intolerance or dietary requirement of your guests in the special instructions before you confirm your Order. We will tell you if a requirement cannot be met. You are responsible for passing on allergen information to your guests.

9.3.Veg and Non-Veg. Vegetarian dishes are prepared without meat, poultry, fish or eggs unless clearly stated. Where an Order includes both Veg and Non-Veg dishes, Vendors are required to keep them separate during preparation and service.

9.4.Food safety. Vendors are required to hold a valid FSSAI licence or registration and follow the Food Safety and Standards Act, 2006 and its regulations.

9.5.Reporting a problem. If something is wrong with your food or service, please tell the on-site team during the event, or contact us within 24 hours of the event with your Order Number and, where possible, photos. This helps us investigate fairly and quickly. Reporting later does not take away your statutory rights, but it may make it harder to verify the issue.

10. Reviews & Ratings

10.1.Once an Order is marked Completed, you can submit an overall rating and review, and rate individual dishes.

10.2.Reviews must be honest and based on your own experience. They must not be unlawful, defamatory, obscene, abusive or misleading, and must not reveal anyone's private information without consent.

10.3.We do not edit the meaning of reviews or remove them simply because they are negative. We may moderate, withhold or remove reviews that break these rules, and we or the Vendor may respond to reviews.

10.4.You may only review Orders you placed, and only once per Order. Paid, incentivised or fake reviews are not allowed.

11. Your Conduct

You agree not to:

11.1.use the Platform for any unlawful purpose or in breach of Applicable Law;

11.2.impersonate any person, or misrepresent your identity or affiliation;

11.3.interfere with the Platform, including by introducing malware, sending excessive automated requests, or reverse-engineering or decompiling the app, except as permitted by law;

11.4.try to gain unauthorised access to any Account, system or network connected to the Platform;

11.5.harass, threaten or abuse our staff, Vendor staff or other Users, online or at the event;

11.6.use fraudulent payment methods, or misuse coupons, referrals or refunds;

11.7.scrape, copy or redistribute Platform Content for commercial purposes without our written consent; or

11.8.ask a Vendor to serve or handle anything unlawful or unsafe at your event.

We may suspend or terminate your Account and cancel Orders if you breach this Section (see Section 18).

12. Intellectual Property

12.1.The Platform, including its software, design, logos, the "Book Your Menu" name and marks, and Content (other than content submitted by Users), is owned by or licensed to Book Your Menu and protected by law.

12.2.We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Platform to plan and book catering for your own events, in line with these Terms.

12.3.You keep ownership of reviews, ratings and photos you submit. By submitting them, you grant Book Your Menu a worldwide, royalty-free, non-exclusive licence to use, reproduce, display and publish them to operate and promote the Platform. You confirm you have the right to grant this licence.

13. Vendors & Our Marketplace Role

13.1.Where an independent Vendor fulfils your Order, Book Your Menu lists the Vendor's Packages, facilitates booking and payment, and coordinates customer support. The Vendor is responsible for food preparation, food safety, its staff and on-site service quality.

13.2.We require Vendors to hold valid food safety licences (including FSSAI registration or licence) and to follow our food safety and service standards. Vendor details, including name and licence information, are available on request through support@bookyourmenu.com.

13.3.We will help you resolve any complaint about a Vendor, including coordinating refunds that are due to you. Nothing in this Section limits our own responsibility for Orders we fulfil ourselves, or our obligations as an e-commerce entity under Applicable Law.

14. Third-Party Services

14.1.The Platform uses third-party services, including payment processing (Razorpay), maps and location, OTP/SMS delivery, push notifications and cloud storage. Your use of those services is also subject to their own terms and privacy policies.

14.2.We are not responsible for the acts, omissions or downtime of third-party providers, except where Applicable Law makes us responsible.

15. Disclaimers & Limitation of Liability

15.1.Platform availability. We work hard to keep the Platform available and secure, but it is provided on an "as is" and "as available" basis, and we do not promise that it will always be uninterrupted or error-free.

15.2.Limit on liability. To the maximum extent permitted by Applicable Law, our total liability to you for any claim arising from these Terms or an Order is limited to the total amount you paid for the Order that gave rise to the claim.

15.3.Indirect loss. To the maximum extent permitted by Applicable Law, we are not liable for indirect, incidental, special or consequential loss, including loss of profit, business, reputation or opportunity.

15.4.What we do not limit. Nothing in these Terms limits or excludes (a) liability for death or personal injury caused by our negligence, (b) liability for fraud or wilful misconduct, (c) your rights as a consumer under the Consumer Protection Act, 2019, or (d) any other liability that cannot be limited under Applicable Law.

16. Indemnity

You agree to indemnify and hold harmless Book Your Menu, its officers, employees and agents against claims, losses, damages and expenses (including reasonable legal fees) caused by: (a) your breach of these Terms; (b) your misuse of the Platform; (c) your breach of any law or of the rights of a third party; or (d) content you submit. This does not apply to the extent a loss is caused by our own breach or negligence.

17. Force Majeure

17.1.Neither you nor we will be liable for failure or delay caused by events beyond reasonable control, such as natural disasters, extreme weather, epidemics, government orders or restrictions, strikes, riots, or widespread power or internet outages.

17.2.If such an event affects your Order, we will first offer to reschedule it. If rescheduling is not possible, we will refund the amount paid, less only reasonable costs already incurred that cannot be recovered, which we will show you.

18. Suspension & Termination

18.1.We may suspend or terminate your Account, and cancel pending Orders, if you seriously or repeatedly breach these Terms, act fraudulently or abusively, or if the law requires it. Where reasonable, we will tell you why.

18.2.If we terminate your Account without fault on your part, any confirmed Orders will be honoured or fully refunded.

18.3.Sections that by their nature should survive termination, including Sections 12, 15, 16, 20 and 22, will continue to apply.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes in the app or using your Account contact details at least 7 days before they take effect, unless a change is required sooner by law. Updated Terms will not apply to Orders confirmed before they take effect. If you do not agree to a change, you may stop using the Platform and close your Account.
